Rental Conditions
GENERAL CONDITIONS: The LESSEE declares having received the vehicle in perfect condition, undertaking to return it in the same condition. The LESSEE is responsible for damages caused to the vehicle, as well as its theft or loss. The LESSEE also receives an expert report detailing the damages, kilometres and fuel present in the vehicle at the start of the rental. This section includes a table with estimated values for the most common vehicle damages. In the event of a damage assessment upon return, both the LESSOR and the LESSEE shall be governed by said table. The LESSEE will leave a deposit. This deposit will be returned in full after a maximum of 7 calendar days if the vehicle is returned correctly. Part or all of the deposit may be withheld for breach of the contract clauses.
INSURANCE: The LESSOR offers the LESSEE mandatory and civil liability INSURANCE, plus occupant insurance according to the conditions stipulated by the insurance company. It also offers accident insurance for own damages (CDW) plus theft INSURANCE (TP), with an EXCESS on the rented vehicle. The LESSEE may be exempt from the EXCESS (SCDW) by paying the corresponding premium, which is reflected in the current general tariff. In any case, and even with the exception of an EXCESS, keys and locks, the undercarriage, roofs, wheels, glass/windows, interiors and upholstery are excluded from coverage. Fuel errors are also excluded. You may also purchase PREMIUM INSURANCE (SP) to cover wheels, glass and locks. In no case does the INSURANCE include the theft of personal belongings from inside the vehicle. Vehicle cleaning, should the staff deem it appropriate, will have a cost between 60 and 150 euros. For mopeds and motorcycles, the loss, theft or damage of helmets and keys, as well as tears in the seat upholstery, are excluded from coverage. In the event of theft, the LESSEE must present the relevant police report and the vehicle keys, otherwise the INSURANCE will be void.
In the event of an accident, it must be communicated immediately to the LESSOR and the accident report must be presented, duly completed and validated by the insurance company, otherwise the INSURANCE will be void. The INSURANCE will also be void in the following cases:
a) The vehicle is driven by a person other than the LESSEE or ADDITIONAL DRIVER.
b) The driver violates Traffic Code laws.
c) Damages are caused intentionally.
d) More people than authorized are riding in the vehicle.
e) The vehicle is driven off-road.
f) The driver drives under the influence of alcohol or other narcotic substances.
g) The LESSEE uses it for any activity that directly or indirectly implies subleasing the vehicle.
h) The vehicle is driven negligently, leading to breakage or notable wear of one or more of its parts.
When the INSURANCE is invalidated, the LESSEE will be responsible for the total repair of the vehicle as well as administrative expenses and the vehicle's downtime days, according to the rate in effect at the time of the downtime. In the event of an accident, an amount of 95 euros will be charged as administrative expenses, regardless of the INSURANCE contracted by the LESSEE.
REPAIRS: The LESSOR will not pay the amount for repairs performed by persons without written authorization, and is not responsible for any agreement between the LESSEE and a person outside the company. In the event of a breakdown, the LESSOR requires a minimum time to solve the problem. This time is estimated at 72 working hours. In the event of having to request tow truck assistance for causes external to the company (leaving lights on, loss of keys, broken lock cylinder, etc.), the LESSOR will charge an amount between 100-150 euros for said assistance, unless roadside assistance has been offered and contracted.
RETURN OF THE VEHICLE: The LESSEE must deliver the vehicle at the agreed place and time. If the vehicle is returned early, the LESSEE will not be entitled to any refund. In the event of a late return, the LESSEE will be charged for the corresponding rental days according to the current rate and not the initial rental rate, plus a penalty of 25 euros per day. In any case, the LESSOR offers a one-hour courtesy period regarding the scheduled return. If the vehicle is parked at K10 Rent a Car facilities while rented, a penalty of 30 euros will be charged. Returns outside office hours must be requested at the start of the rental, and only upon acceptance by the LESSOR. In the case of an out-of-hours return, the LESSEE will remain responsible for the vehicle until the next opening of the premises where the return was made. If the vehicle is not returned within the established period, the LESSOR is entitled to take charge of the vehicle or to claim it legally. In the event of modification or extension of your contract, you must notify the company at least 48 hours in advance and appear at the K10 Rent a Car facilities. In any other case, vehicle availability cannot be guaranteed. Extensions requested by phone or email will not be accepted.
FUEL AND FINES: These are the responsibility of the LESSEE. In the event of returning the vehicle with a lower amount of fuel than upon collection, the LESSEE will be charged the value of the missing fuel plus a refuelling service fee of 17 euros. In the event that the Company receives a fine or sanction without prior notice from the driver, between 19-49 euros will be charged as management fees. This does not include the amount of the fine or sanction.
EXTRA CHARGES: The LESSEE authorizes the LESSOR to charge their credit or debit card for all extra charges generated by the rental or return of the vehicle, including those generated once the rental has ended. They also authorize these charges to be deducted from the deposit placed by the LESSEE at the start of the rental. There is a damage table attached to this document showing common damages and their price by group.
JURISDICTION: In the event of litigation derived from this contract, both parties submit to the courts and tribunals of Ibiza, expressly waiving any other jurisdiction.
LANGUAGE: There may be errors in the language translation. For the purposes of the contract, both parties will be governed by the conditions written in Spanish.
I have read and declare my agreement with what is stated on the front, as well as with the rest of the GENERAL CONDITIONS defined above and the attached damage table. Likewise, if this rental is to be charged to a credit or debit card, my signature authorizes the LESSOR to charge the final amount to my account with the issuing entity and it is considered accepted on the Entity's charge number.
